Description

New Haven County Superior Court Divorce Cases Collection, 1701‑1859

Overview

This digital collection preserves the complete set of divorce‑related documents issued by the New Haven County Superior Court from 1701 through 1859. It is held by the Connecticut State Library and is part of the NHSC BAAI (Black, African American, and Indigenous History) retrospective series. The collection consists of high‑resolution JPEG and TIFF scans, OCR‑derived text, and structured PINAX metadata for each item. It is organized into dozens of individual case files—Adkins, Brockway, Clark, Freeman, and many others—each representing a single legal proceeding.

Background

The New Haven County Superior Court was the primary civil court for the county during the colonial and early‑state periods. The Connecticut State Library’s New Haven County project, funded by the National Historical Publications and Records Commission, digitized these records to preserve and make accessible the legal experiences of marginalized communities. The NHSC BAAI project specifically indexes cases involving Black, African American, and Indigenous individuals, thereby highlighting issues of slavery, interracial relations, domestic abuse, and property disputes within the context of marriage dissolution.

Contents

The collection includes petitions, summonses, decrees, marriage certificates, depositions, witness testimonies, and ancillary court papers for each divorce case. Sub‑collections cover individual cases such as the 1752‑1774 Adkins divorce, the 1758‑1769 Brockway case, the 1835‑1836 Cann petition, and the 1859 Clinton divorce, among many others. Each file is accompanied by metadata that records creator names, dates, subjects, and geographic references, and is linked to the NHSC BAAI Cases Papers Subject index.

Scope

The collection spans 1701‑1859, covering New Haven County and surrounding towns (Wallingford, Farmington, Waterbury, Guilford, Branford, etc.). It focuses exclusively on divorce proceedings and related legal documents; criminal cases, probate, or other civil matters are excluded. All materials are in the public domain and available for scholarly, genealogical, and educational research in legal history, African‑American studies, and the social history of early Connecticut.

**SYNTHESIS NOTES**

* The @file_pinax collection aggregates **all** divorce‑related case materials from the New Haven County Superior Court spanning **1701‑1859**, linking dozens of individual creators (e.g., @joseph_adkins, @samuel_brockway, @hope_marks) who also appear as contributors in their respective sub‑collections.

* Every sub‑collection (Adkins, Brockway, Clark‑Horton, etc.) is **indexed by the same subject field** — @nhsc_baai_cases_papers_subject — demonstrating a unified BAAI (Black, African American, and Indigenous) indexing strategy across the entire project.

* Core concepts such as **Divorce**, **Marriage**, **African American History**, **Racial Identity**, and **Legal History** recur in all sub‑directories, indicating thematic cohesion.

* Geographic scope is consistently New Haven County and its towns (Wallingford, Farmington, Waterbury, Guilford, Branford, etc.) plus neighboring locales (Portsmouth NH, Boston MA, Albany NY), reflecting the court’s jurisdictional reach.

* Persons like **@samuel_brockway**, **@joseph_adkins**, and **@hope_marks** serve as **linking nodes**: they are creators of both the overarching @file_pinax metadata and of specific case collections, illustrating how individual researchers/recorders contributed to multiple parts of the project.

* The synthesis highlights a **centralized metadata layer** (@file_pinax) that connects disparate case collections through shared creators, subjects, places, and the common indexing schema, enabling integrated search and analysis of divorce, race, and legal history across 18th‑ and 19th‑century Connecticut.
