At a Superior Court held at New Haven, in and for the County of New Haven, on the Tuesday of December A.D., 1859. Upon the Petition of Sarah Clinton of the Town of Woodbridge SHOWING that on or about the 12th day of July A.D. 1856 she was lawfully married to Freeman P. Clinton of said Town with whom the petitioner lived, in the performance of all the duties of the marriage covenant, on part to be performed, until on or about the 1st day of February A.D. 1854 when the said Freeman P. Clinton the respondent willfully deserted the petitioner, and has continued said desertion, with total neglect of all the duties of the marriage covenant, on his part to be performed, from thence hitherto, for a period of more than three years last past. And further shewing that the said respondent, has at divers times during said period committed adultery with and with divers fewd persons, to the petitioner unknown. And further shewing that the said respondent for a period of more than three years last past has been and now is habitually intemperate. And further shewing that the said respondent for a period of more than three years last past has been continually guilty of intolerable cruelty towards the petitioner. And further shewing that the said respondent for a period of more than three years last past has been guilty of such misconduct as permanently destroys the happiness of the petitioner, and defeats the purposes of the marriage relation. And further shewing that the petitioner has three minor children, the issue of said marriage, viz: James G. Clinton, Charles E. Clinton, and Lawrence Willis Clinton. Praying for a Divorce, and that the Court award the charge and custody of said minor children to the petitioner, and for the divorce of the respondent. as by said petition on file, dated the 3rd day of December A.D. 1859 more fully appears. This petition came to the present term of this Court. The Court find that said petition has been duly served on the respondent, pursuant to an order of notice made therein by Superior Court as appears by the officers return thereon endorsed. And now the petitioner appeared to prosecute said petition; and the respondent being called, appeared not. Whereupon, the allegations in said petition having been proved and found true, it is adjudged, ordered and decreed, by this Court that the said Sarah Clinton be and he is hereby divorced from the said Freeman P. Clinton and discharged from all the duties and covenants to him by reason of the marriage aforesaid. And the said Sarah Clinton is hereby declared to be single and unmarried. And the Court hereby award to the petitioner the charge and custody of said minor children. And the name of the said petitioner is hereby ordered and declared to be changed to that of Sarah Clinton, by which name she shall hereafter be known and called. I, Clerk of the Superior Court within and for said County, hereby certify the foregoing to be a true copy of record. In testimony whereof, I have hereto set my hand and the seal of said Court, this day of A.D. 1859. Clerk.
