Description

Depositions Regarding Margaret Brockway’s Mental State

Overview

This collection comprises five contemporaneous depositions taken in 1758–1759 in New Haven County, Connecticut, concerning the mental condition of Margaret Brockway, wife of Samuel Brockway, in the context of a divorce proceeding. The documents are preserved as scanned images (JPEG and TIFF) and are part of the Connecticut State Library’s digitized “New Haven County Superior Court Files – Black, African American, and Indigenous” (NHSC BAAI) project.

Background

The depositions were recorded by local Justices of the Peace—Hezekiah Gridly, Matthew Justice of Peace, Geo. Matthews, Thomas Matthew, and Pho. Matthews—at various county locations (Farmington, Waterbury, and Water City). They were sworn by a range of community members: Beck Moses Blackley; Capt. Phineas Royce, Mr. Jonathan Cook, and Mrs. Lydia Barnes; Mr. Samuel Curtis and Elizabeth Curtis; Henry Cook and Ebenezer Cook; and Deacon John Warner. The case was filed in the New Haven County Superior Court, reflecting the legal practices of mid‑18th‑century Connecticut.

Contents

The collection contains five depositions:
  • Deposition 001 – Beck Moses Blackley, Farmington, 26 Feb 1759, asserting Margaret Brockway’s “bad behaviour” and “distracted” state.
  • Deposition 003 – Capt. Phineas Royce, Mr. Jonathan Cook, and Mrs. Lydia Barnes, Waterbury, 25 Aug 1758, noting Margaret’s general conduct.
  • Deposition 005 – Mr. Samuel Curtis and Elizabeth Curtis, Waterbury, 30 Aug 1758, describing Margaret as a “distracted” and “possessed” woman.
  • Deposition 007 – Henry Cook and Ebenezer Cook, Waterbury, 30 Aug 1758, recounting long‑standing observations of Margaret’s erratic behaviour.
  • Deposition 010 – Deacon John Warner, Water City, 20 Aug 1758, affirming Margaret’s “distracted” condition and citing prior incidents.
  • Each deposition is accompanied by a scanned image of the original parchment, with OCR transcriptions available for research use.

    Scope

The collection covers the period 25 Aug 1758–26 Feb 1759, focusing on the legal and social perceptions of mental health in a 18th‑century New Haven County divorce case. It includes depositions from three towns within the county and reflects the community’s involvement in court proceedings. The materials are relevant to scholars of early American legal history, mental health, and gender studies, and they illustrate the role of local witnesses in shaping judicial outcomes during the colonial era.
