Description

Execution Warrant for Timothy Malankuss Collection

Overview

The Execution Warrant for Timothy Malankuss Collection is a small archival set held by the Connecticut State Library. It comprises a single 18th‑century legal document issued by the New Haven County Superior Court, accompanied by high‑resolution digital copies (JPEG and TIFF) and associated metadata. The warrant, dated 1 September 1770, orders the execution of a sentence against Timothy Malankuss, an Indigenous man convicted of murder.

Background

In colonial Connecticut, criminal proceedings against Native Americans were recorded in the same court system that served the colonial population. The New Haven County Superior Court issued the warrant under the authority of the colony’s legal framework. The document reflects contemporary punitive practices—whipping, branding, and forfeiture of property—used to enforce colonial law. The warrant is part of the library’s “NHSC BAAI Cases Papers Subject” index, which catalogs court files involving Black, African American, and Indigenous individuals.

Contents

  • Original warrant (paper): A handwritten, formal order addressed to the Sheriff of New Haven County, detailing the sentence of 39 stripes of whipping, branding of the hand with the letter “M,” and forfeiture of all goods to the public treasury.
  • Digital facsimiles:
  • - RG003NHSCBAAIPSExecutionsRexvsMalankuss001.jpg – a JPEG scan with OCR text extracted from the warrant. - RG003NHSCBAAIPSExecutionsRexvsMalankuss001.tif – a high‑resolution TIFF scan preserving the original layout and marginalia.
  • Metadata: JSON records describing the document’s provenance, subject headings, and relationships to other archival entities (e.g., the clerk Geo Bathen, the sheriff, and the victim Joseph Charles).

Scope

The collection covers a single legal event in colonial Connecticut: the sentencing of Timothy Malankuss for the murder of Joseph Charles in August 1770. It is geographically bound to New Haven County, Connecticut, and temporally confined to the early colonial period (1770). The materials focus on criminal justice, Indigenous‑colonial relations, and punitive law, and they exclude broader court proceedings or unrelated documents. The collection is in the public domain, reflecting its age and the nature of the source material.
